SS 304 The Supreme Court and the First Amendment:
The Legal History of Free Speech
Americans believe the First Amendment protections for free speech and religion are absolute, but this course explores the legal boundaries drawn by the Supreme Court. This term covers the history of "freedom of speech." Part 2, in the spring term, will cover "freedom of religion."
Week 1. Sedition and the First Amendment: Are there different standards for free speech during war and during peace? The First Amendment states, "Congress shall make no law . . . abridging freedom of speech," but it did pass the Espionage/Sedition Acts of 1917-18 outlawing criticism of the government. Was this a violation of the First Amendment?
Week 2. When does free speech cross the legal line and lose its First Amendment protection? In Brandenburg v. Ohio (1969), the Court decided whether a Ku Klux Klan leader could be sent to prison for giving an inflammatory speech at a Klan rally.
Week 3. When is symbolic speech protected under the First Amendment? Do you have a constitutionally protected right to protest by burning your draft card or the flag, or wearing an armband to protest the war? Are such symbolic expressions of "free speech" protected? Presenter: Fran Solmor, a licensed attorney in California, New York, and Texas, received her degrees from University of Chicago, Columbia University, and Pace University School of Law, where she was a member of the Law Review. This is her fifth course for OLLI in a series of Great Constitutional Conversations. She practices law in the area of trusts and estates for the Law Office of Fay Blix in Laguna Hills, where her focus is Special Needs Trusts.
